====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 307, 384, 386, 504/34 of the Indian Penal Code.

As per prosecution case, this petitioner and other F.I.R. named accused persons assaulted the students of the institute of the informant and also intimidated them. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has been made accused in this case only because his house is situated near the Sitamarhi Institute of Technology. It is further submitted that similarly situated co-accused person has already been granted anticipatory bail by this Hon'ble Court vide order dated 13.04.2023 passed in Cr. Misc. No. 4924 of 2023. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Dumra P. S. Case No. 306 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
