JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-03-2019 The petitioner apprehends his arrest in connection with Sonpur P.S.Case No. 546 of 2018 registered under Sections 363, 366, 368, 376 and 379of the Indian penal Code. Allegation against the petitioner is that he kidnapped the married daughter-in-law of the informant having two children. Submission of learned counsel for the petitioner is that she has filed an affidavit in the court below that she has gone to her Maika and nobody has kidnapped her and furthermore, present case has been lodged as the son of the co-accused Munna Das had filed Sonepur P.S.Case No. 258 of 2018 against the sons of the informant.

Heard learned APP also who has opposed the prayer for bail on the ground that impugned order shows that girl is still traceless.

Having heard both sides and in view of the facts and

No.4034 of 2019(3) dt.11-03-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered on the basis of material available on record and also the statement of girl if so recorded within that period and will dispose of prayer of regular bail, without being prejudiced by this order, if possible, on the same day.
