Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302 and 120(B) of the Indian Penal Code.
According to FIR, the petitioner asked the son of the informant to go for work. Son of the informant was not willing to go. Thereafter the petitioner forcefully took him. In the next morning, dead body of the son of the informant was sent on a Thela to the house of the informant. The Doctor has found a case of asphyxial death due to twisting of neck. Though there is no direct evidence that the petitioner had twisted the neck, the attending circumstances appearing in
Patna High Court CR. MISC. No.2181 of 2020(4) dt.17-06-2020 2/2 the case does not permit the conscious of the Court to allow anticipatory bail to the petitioner. Hence, prayer of the petitioner for grant of anticipatory bail is refused in connection with Mansoorchak P.S. Case No. 87 of 2019 pending in the court of learned 1st Additional Chief Judicial Magistrate, Begusarai/successor Court.
Petitioner is directed to surrender and pray for regular bail.
