JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. It is an admitted position that after investigation police did not find accusation true against the petitioners and accordingly, they were not sent up for trial but the learned Chief Judicial Magistrate differed with the findings of the police and took the cognizance of the offence against the petitioners and others also. Moreover, co-accused, Md. Ali Hussain @ Munna has already been granted privilege of bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction
