====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 20-12-2024 Heard learned counsel appearing on behalf of the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Chandan (Anandpur O.P.) P.S. Case No. 184 of 2023 dated 19.11.2023 registered for the offences punishable under Sections 376(DA), 120(B) and 506 of the I.P.C. and Section 4 of the POCSO Act.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 22.02.2024.

4. Learned counsel for the petitioner submits that similarly situated co-accused Mithilesh Yadav @ Mithilesh

Patna High Court CR. MISC. No.64318 of 2024(3) dt.20-12-2024 2/2 Kumar Yadav had approached this Court seeking regular bail by filing Cr. Misc. No. 5732 of 2024 and the same was allowed by an order dated 20.12.2024. It is further submitted that while granting regular bail to Mithilesh Yadav, the Court has considered the case on merit and in detail. It is thus submitted that petitioner also be granted the privilege of regular bail based on parity.

5. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

6. Considering the submissions and taking into consideration the order dated 20.12.2024 in Cr. Misc. No. 5732 of 2024, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chandan (Anandpur O.P.) P.S. Case No. 184 of 2023.
