Mr.Manish Kumar- GP4 ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 31-01-2019 Heard learned counsel for the petitioner and the State. Following are the reliefs, sought for by the petitioner in the present writ application:
"(I) For issuance of an appropriate writ in the nature of mandamus commanding and directing the Respondent No. 2 for disposal of Arms Licence Case No. 126 of 2017 which is pending consideration before the Respondent No. 2 at least since 15-05-2017 in respect of which the petitioner had filed his application on 19-09-2016 and he has been recommended for grant of licence by the Respondent Nos. 4 to 9.
(II) For a declaration that if application of the petitioner for grant of Arms Licence on account of danger to his life and property
Patna High Court CWJC No.21088 of 2018(2) dt.31-01-2019 2/2 was recommended by the Respondent nos. 4 to 9, there was no occasion for the Respondent no. 2 to keep the matter pending before him since ling.
(III) For issuance of any other appropriate writ/writs, order/orders, direction/directions for which the writ petitioner would be found entitled under the facts and circumstances of the case".
On behalf of the petitioner, it has been contended that Arms Licence Case No. 126 of 2017 was initiated with regard to grant of arms licence, in question. The said case is pending till date and, no final order has been passed in spite of the fact that reports have already been submitted by the concerned authorities.
The District Magistrate, Saran at Chapra (respondent No. 2) is directed to dispose of the aforesaid case in accordance with law within a period of three months from the date of receipt/production of copy of this order.
With the aforesaid observation/direction, this writ application stands disposed of.
