The petitioner seeks bail in connection with Madanpur P.S. Case No. 321 of 2021 instituted for the offences under Sections 30(a) and 33 of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 04.11.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 1505 litres liquor from a pickup van and 70 litres of spirit from a Hyundai Car.

Learned counsel for the petitioner submits that the petitioner is the driver and owner of the Hyundai Car and was not knowing who had kept the spirit in the car for falsely

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-I, Aurangabad in connection with Madanpur P.S.
