The petitioners are in custody in connection with Special Case No.6133/2021 arising out Paliganj P.S. Case No.362 of 2021 registered for offences under Sections 30(a), 33, 35, 36 and 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Petitioners are driver and cleaner of the truck. They belong to the State of Haryana and they have clean antecedents. They are in jail custody since 28.09.2021.

Considering the allegations levelled against the petitioners and there is huge recovery of illicit liquor, this

Patna High Court CR. MISC. No.3986 of 2022(2) dt.23-05-2022 2/2 application for bail is allowed subject to the condition that petitioners will deposit a sum of Rs.50,000/- in the account of the District Legal Aid Committee, Patna.

Accordingly, let petitioners, above-named, be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special JudgeExcise, Danapur in connection with Special Case No.6133/2021 arising out Paliganj P.S. Case No.362 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. However, before accepting bail bonds of the petitioners, the court below will verify the receipt showing deposit of a sum of Rs.50,000/- in the account of the District Legal Aid Committee, Patna.

Before releasing the petitioners, the court below will verify their addresses and their bailors should be parents, brothers/sisters.
