JUSTICE AMARESH KUMAR LAL ORAL ORDER 21-04-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201/34 of IPC. FIR was lodged against unknown by the Dafadar when the dead body of an unknown girl aged about 20 years was found. During investigation, it has come to light that a quack doctor Suresh Chaudhari had illicit relation with the wife of the petitioner and one day deceased Soni Kumari saw both of them in compromising position which was protested by her and thereafter she was assaulted brutally by them. She became senseless. Suresh administered saline water but the deceased did not regain her sense. In the meantime, the father of the deceased came there. In the way to hospital for her treatment, she succumbed to her

Patna High Court Cr.Misc. No.6653 of 2015 (3) dt.21-04-2015 2/2 injuries. Thereafter, the dead body was thrown by the accused including the petitioner.

It is submitted that there is no allegation that the petitioner has killed the deceased. The petitioner is the father of the deceased and he has no criminal antecedent. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Atul Kumar Singh, Judicial Magistrate, 1st Class, Samastipur/court concerned in Khanpur P. S. Case No. 119 of 2014 with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
