JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is languishing in jail since 28.11.2015 in a case registered for the offences punishable under Section 341, 323, 324, 307 and 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-fulfill of the dowry demand and making assault.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and birth of three child and is ready to keep them with full dignity and honour, statement to that effect has been made in para 11 of the petition
Patna High Court Cr.Misc. No.10121 of 2016 (2) dt.01-03-2016 2/2 which reads as follows:- "That it is humbly submitted that the petitioner is husband of complainant and ready to keep his wife with full dignity and honour."
It is further submitted that the injury has been found to be simple superficial in nature. Moreover, the investigation has already concluded.
Considering the nature of accusation and the fact that the investigation has already concluded, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Araria in connection with Jokihat P.S. Case No. 333 of 2015.
