The petitioners seek bail in connection with Excise Case No. 241 of 2021 arising out of Mashrakh P.S. Case No. 396 of 2021 instituted for the offences under Sections 30(a), 32(2) and 32(3) of the Bihar Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 08.12.2021, are persons with clean antecedent and charge-sheet has been submitted in the case.

Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.4552 of 2022(2) dt.07-03-2022 2/2 allegation is of recovery of 518.4 litres of liquor from a mini bus.

Learned counsel for the petitioners submits that the petitioners have been arrested on the basis of suspicion as they were travelling in the mini bus and as such were not knowing who had kept the liquor in the bus.

Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody, are persons with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise, Saran at Chhapra in connection with Excise Case No. 241 of 2021 arising out of Mashrakh P.S. Case No. 396 of 2021.
