The petitioner seeks bail in connection with Shikarpur P.S. Case No. 315 of 2021 registered for the offences punishable under Sections 279, 337, 338, 379, 411, 427 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 06.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. It is stated by the informant that he visited the house of his phupha on 26.06.2021 and parked his motorcycle outside the house but when he came out from the house found his motorcycle missing. He started searching and in the meanwhile, he got information that accident has taken place of motorcycles near Koerigawan Chowk. On reaching the spot, the informant found that three riders have been badly injured. One of the

Learned counsel for the petitioner submits that the petitioner is an innocent person and falsely implicated in this case. He further submits that petitioner was not caught on the spot, not even stolen motorcycle was recovered from his possession as would appear itself from the seizure list. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 315 of 2021.
