ANJANA MISHRA ORAL ORDER 21-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 03.12.2019 in connection with Jamalpur P.S. Case No.131 of 2019 registered for the offence under Section 379/411 of the Indian Penal Code.
Learned counsel for the petitioner submits that from the cutting and removal of the trees from Danga Pokhar, the Government has sustained revenue loss and, therefore, the seizure list was prepared. The petitioner has been named subsequently along with one Ram Udghar Yadav. It is further submitted that said Ram Udghar Yadav has already been extended the privilege of bail. It is further submitted that the F.I.R. in the present case was lodged after a delay of four
Patna High Court CR. MISC. No.2664 of 2020(2) dt.21-01-2020 2/2 days, for which no plausible explanation has been given by the Anchal Adhikari. Learned counsel for the petitioner further submitted that the petitioner is a respectable person and is running a saw mill and has nothing to do with the cutting of trees. It is further submitted that the petitioner has no criminal antecedents.
Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Jamalpur P.S.
