The petitioner is accused in connection with Begusarai Muffasil (Singhaul) P.S. Case No. 188 of 2016 registered under Section 302 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of Chief Judicial Magistrate, Begusarai. The accusation is that due to land dispute petitioner shot fire at his brother, Adalat Yadav, brother-in-law (Bhaisur) of informant, who died on the spot.

Four antimortem firearm injuries were found on the person of the deceased as appear from the photo copy of the postmortem report. Injuries nos. 1 and 3 are communicated to injuries nos. 2 and 4.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
