Petitioner seeks bail in Mojahidpur (Babarganj) P.S.Case No.149 of 2013 (G.R.No.3431 of 2013) registered under Sections 20(b)(c), 23(c) and 25 of N.D.P.S. Act. The police raided the joint house of the petitioner and his brother Lakhan Sah and from their possession, 93.525 kgs. Ganja and some foreign currency notes were recovered. Sri B.P. Pandey, learned Senior Counsel, appearing for the petitioner submits that the Ganja was not recovered from the room of the petitioner rather the same was recovered from the room of his brother Lakhan Sah. The petitioner is not at all involved in smuggling of Ganja.
Having considered the facts that from the joint house of the petitioner and his brother, 93.225 kgs. Ganja was recovered, I am not inclined to enlarge the petitioner on bail and accordingly, the same is rejected.
The trial court is directed to expedite the trial and conclude the same within one year from the date of receipt or
Patna High Court Cr.Misc. No.7698 of 2015 (3) dt.21-04-2015 2/2 production of a copy of this order.
The Superintendent of Police, Bhagalpur is directed to ensure the attendance of the prosecution witnesses during the course of trial so that the trial must conclude within the stipulated period.
