Deceased, who was a handicap, was found dead on tri-rickshaw on 08.02.2015 and for which, informant, his father has filed instant case. He had further disclosed that deceased had left for Chandpura Chowk on 07.02.2015 at about 7.00 p.m., but did not return. It has also been disclosed that on query, he came to know that Ram Balak Sah, Ramanand Paswan and Dharmendra Razak administered wine mixed with poison.
Chargesheet had already been submitted without waiting for forensic report. However, from the statement of the witnesses, it is apparent that deceased Deepak Paswan and coaccused Ram Balak Sah used to sell spurious wine. It has also been stated that deceased was addicted and was regularly visiting
Patna High Court Cr.Misc. No.19203 of 2015 (03) dt.03-07-2015 shop of Ram Balak Sah. He might have died on account of overdrink. Moreover, none had claimed to be an eye witness to occurrence to suggest that on the alleged date and time of occurrence, they have seen all the three accused along with Deepak Paswan consuming wine.
Accordingly, petitioner, Ramanand Paswan @ Ram Paswan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Begusarai in connection with Neema Chandpura P. S. Case no.07 of 2015.
