The petitioner is apprehending his arrest in connection with Deepnagar P.S.Case No.253 of 2019 registered for offences punishable under Sections 363, 504 and 506/34 of the Indian Penal Code.

Prosecution case is of kidnapping of the minor daughter of the informant. It appears from the impugned order that the victim girl has been recovered and she has stated that she has married with the petitioner on her own sweet-will , however, the learned Addl. Sessions Judge has rejected the prayer for bail on the ground that as Section 366(A) is not inserted, this application is not maintainable.

In view of above, this application is disposed of with liberty to the petitioner that if any such situation arises, he may file fresh application but prior to that he has to move before the learned Sessions Judge for gran of anticipatory bail.
