JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioner and learned APP for the State.

The petitioner is languishing in custody since 23.03.2015 in case registered for the offences punishable under sections 365/511, 354,34 of the Indian Penal Code and 12 of the Protection of Children from Sexual Offences Act, 2012. The prosecution case is that the informant along with one Asmita Kumari were travelling on an auto rickshaw when they asked the drive to stop the same the driver tried to take them to some other directions when the informant and her friend jumped from the auto rickshaw. The FIR was registered against unknown but during investigation, statement of witnesses, the petitioner was apprehended being an auto rickshaw driver.

No.19414 of 2015 (3) dt.25-06-2015 2/2 It is submitted by learned counsel for the petitioner that even assuming the accusation, no offence under sections 365/511 or 354 of the Indian Penal Code is made out. The petitioner is in custody since 23.03.2015 but till date he has not been put on TI Parade. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Aurangabad in connection with Aurangabad Town P.S.
