According to the prosecution case itself, alleged recovery has been made from cowshed of co-accused Deepak Sharma who disclosed that the aforesaid motorcycle had been kept by the petitioner.

No doubt, petitioner carries criminal antecedent but in the present case, except the above stated confessional statement of the aforesaid co-accused, there appears to be nothing against the petitioner.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri B.M. Tripathi, Judicial Magistrate, Ist Class, Jehanabad/ concerned court in Karpi P.S. Case no. 253/2014.
