Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is named in the first information report and according to prosecution case itself, the informant is not an eye witness of the alleged occurrence and when he reached on the place of occurrence, he came to know from his villagers that some unknown persons committed the murder of the deceased.

No.10640 of 2016 (2) dt.08-03-2016 2/2 Moreover, informant expressed his suspicion against the petitioner and other F.I.R. named accused persons and in course of investigation, some witnesses stated that petitioner and other accused had collected donation for giving to a shooter so that deceased could be eliminated. Moreover, one co-accused, Bindeshwar Singh @ Bindeshwar Mahto has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Samastipur in connection with Samastipur (Muffasil) P.S.
