JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 This is an application for grant of anticipatory bail in connection with Khagaria (Muffasil) P.S. Case No. 207 of 2018, disclosing offences under Sections 147, 148, 149, 448, 341, 323, 307, 302, 379, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner and several other accused persons is that they have surrounded the house of the informant and there is specific allegation of firing against coaccused Ashok Yadav, who fired on the order of co-accused person Atmaram Yadav, which hit the Bhabho of the informant, who succumbed to the injury and there is also allegation of indiscriminate firing against all the other accused persons. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria, in connection with Khagaria (Muffasil) P.S. Case No. 207 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
