The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354 and 506 of the IPC.

The prosecution case, as per the written report of 27.10.2018, submitted to the Station House Officer, Kadwa Police Station, is to the effect that on 23.10.2018 at 11 P.M., the informant went to ease out in the courtyard when this petitioner caught hold of her and tried to outrage her modesty and on alarm being raised, he assaulted the informant with fists and escaped from the scene.

It is submitted by learned counsel for the petitioner that the

Patna High Court Cr.Misc. No.4163 of 2019(2) dt.28-01-2019 2/2 accusation has been levelled in the background of land dispute. It is further submitted that for the occurrence of 23.10.2018, the FIR was registered on 27.10.2018. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the accusation against the petitioner is specific.

Considering the delayed lodging of the FIR, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S. Case No. 369 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
