Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 354(B), 354(C), 384, 385, 504, 509 and 506/34 of the Indian Penal Code.

Informant who is a school going student alleges that the petitioner used to harass her in different ways when she would be on the way to her school. Other witnesses have also supported the allegation.

Learned counsel for the petitioner submits that earlier case was lodged by the petitioner alleging that family members of the informant of this case had assaulted him.

Patna High Court CR. MISC. No.2194 of 2020(4) dt.10-09-2020 2/2 It might be that the petitioner was assaulted by the family members of the informant for the reasons aforesaid, but that would not minimize the allegation of sexual harassment to an unmarried girl.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on anticipatory bail in connection with Kotwali P.S. Case No. 457 of 2019 pending in the Court of learned C.J.M., Munger.

Hence, prayer for bail of the petitioner is refused. Petitioner may surrender and pray for regular bail which shall be disposed of on its own merit without being prejudiced by this order.
