This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 323, 379, 420, 467 and 468 of the Indian Penal Code. The informant Madhu Devi is the wife of co-accused Nathuni Thakur. Allegedly, petitioner no. 1 got a sale deed executed with respect to the land in question in his favour by said Nathuni Thakur, who is a drunkard, by playing fraud. Learned counsel for the petitioners submits that admittedly a sale deed has been executed in favour of the
Patna High Court Cr.Misc. No.19131 of 2015 (2) dt.25-06-2015 2/2 petitioner no. 1. The petitioner no. 2 is the father of petitioner no. 1, whereas petitioner no. 3 is the identifier in the said sale deed. Petitioner no. 4 is the deed writer.
Keeping in view the nature of dispute and the allegation against the petitioners, let the petitioners abovenamed, in the event of their arrest/surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar, Motihari, East Champaran in connection with Sangrampur P.S. Case No. 188 of 2014 arising out of Complaint Case No. C-2152 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
