JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 19.12.2015 in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code but admittedly, petitioner is not named in the first information report nor anything was recovered from his conscious possession. Furthermore, I find that except confessional statement of petitioner, there appears to be nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.11234 of 2016 (2) dt.10-03-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S. Case No. 525 of 2015.
