JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 304B, 326, 307 and 201/34 of the Indian Penal Code. The marriage of deceased had taken place 6-7 years ago and petitioner happens to be Dewar of deceased. The first information report reflects that deceased spent her married life in her matrimonial home at least for near about 6-7 years. There is no specific allegation of any overt act against the petitioner and having more or less similar allegation, co-accused Meera Devi and Dhanna Mandal @ Vikash Kumar have already been granted privilege of anticipatory bail.

Accordingly, the petitioner above named is directed

Patna High Court Cr.Misc. No.11254 of 2016 (2) dt.10-03-2016 2/2 to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Bath P.S. Case No.36 of 2015.
