Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, petitioner is alleged to have caused fire arm injury to the informant and one Pramod Kumar Singh.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that both the injured were examined by the doctor who found simple injuries caused by hard and blunt substance.

Patna High Court CR. MISC. No.5479 of 2023(3) dt.27-06-2023 2/2 Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail and submitted that doctor found gun shot injury on the person of informant and petitioner has got criminal antecedent of five cases. .

Considering the nature of accusation, gravity of the offence, nature of injury and criminal antecedent, I am not inclined to enlarge the petitioner on pre arrest bail. Accordingly, the same is rejected.
