2. The petitioner seeks bail in connection with Akbarpur PS Case No. 276 of 2023 instituted for the offences punishable under Sections 379, 420 of the Indian Penal Code and Section 66(c) of the I.T. Act

3. As per the prosecution case, some unknown persons has withdraw money from the account of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case merely on the basis of mere suspicion. From perusal of the FIR and impugned order of the learned District and Sessions Judge, Nawada dated 18.12.2023, it appears that petitioner is not named in the FIR and his name

From perusal of the certify copy of the joint compromise petition (Annexure-3), both parties entered into a compromise and compromise petition is already on record and his signature and LTI has also been identified by the concerned persons. Petitioner is in custody since 08.11.2023.

5. Learned APP opposes the prayer for bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Akbarpur PS Case No. 276 of 2023.
