The petitioner is in custody in a case registered under Sections 363,365, 366A, 354, 354A, 354D, 376(2)(1)(M) of the Indian Penal Code and Sections 6 and 10 of the Protection of Children from Sexual Offences Act, 2012.

The prosecution case, in brief, is that the informant Laxmi Narayan Singh filed a written petition on 14.7.2014 before S.H.O., Khagaul Police Station alleging, inter alia, therein that on the previous day at about 5.00 A.M. his son Raushan Narayan Singh, aged about 17 years, and daughter Reshmi Kumari @ Minni, aged about 15 years, had gone for walking from the house and when they did not return till 10.00

Patna High Court Cr.Misc. No.21407 of 2015 (2) dt.14-07-2015 2/3 A.M., the informant frantically searched for them. During the course of search, he came to know from one Arun Kumar Singh of Village-Kothama that they were going in Cantt. Road in front of Mustafapur. He further disclosed that his son and daughter were seen proceeding towards Saguna more with Amit Kumar @ Vikky (petitioner) and Sanjay Singh. He also came to know that the petitioner was chasing his daughter for the last few days. It has been alleged that the informant has reason to believe that the petitioner has kidnapped his daughter for the purpose of marriage.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.12.2014 and the charge sheet has been submitted in the case. It is further submitted that as per the F.I.R. it is being alleged that this petitioner and the victim had eloped. It is further submitted on behalf of the petitioner that the victim and the petitioner have already performed marriage. It is further submitted that other coaccused has been granted bail, vide Cr.Misc. No.16389 of 2015. On behalf of the State and the informant, it is submitted that the main allegation is against this petitioner. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing
