The petitioner apprehends his arrest in connection with Barari P. S. Case No. 171 of 2016 instituted under Sections 147, 148, 323, 341, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation, in brief, is that accused persons intercepted informant's father Hazrat Ali and other while they were going for treatment and they opened fire but did not hit them. Learned counsel for the petitioner submits that in fact, two days earlier, a police case was lodged by the petitioner against Hazrat Ali, the father of the present informant, wherein injury was caused to the informant's side of that case and to save himself, the present counter case has been filed and there is no

No.15304 of 2017 (2) dt.15-06-2017 2/2 injury caused to anyone and as per para-3 of the bail application, the petitioner has got no criminal antecedent, Having considered the aforesaid facts and circumstances, let the petitioner, namely, Hare Ram Mahto, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Katihar in connection with Barari P.S.Case No. 171 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
