The petitioner seeks bail in a case registered for the offences punishable under sections 269, 313 and 314/34 of the Indian Penal Code.
The informant alleged that there was pain in the abdomen of his daughter. The informant brought his daughter to the Nursing Home of the petitioner. Dr. Umesh kumar, petitioner, advised for D & C and took his daughter inside the operation room. There was profuse bleeding and the patient died. The petitioner is not a doctor but he presents himself to be a qualified doctor and gave treatment to the daughter of the informant causing his death.
In the facts and circumstances of the case, I am
Patna High Court Cr.Misc. No.21421 of 2015 (3) dt.04-09-2015 not inclined to enlarge the petitioner on bail in connection with Baniyapur P.S. Case no. 16 of 2015 pending in the court of the learned Chief Judicial Magistrate, Saran at Chapra. His prayer for bail is, accordingly, rejected.
