The petitioners being the husband of informant and father of husband of informant are languishing in custody since 07.12.2015 in a case registered for the offences punishable under sections 498A, 364/34 of the IPC.

The prosecution case is that the informant was driven out by the petitioners from the matrimonial house on 18.11.2015 but the children, one daughter and one son, were kept by the petitioners at the matrimonial house. On 05.12.2015 the informant received information that her daughter has been killed and her dead body has been disposed of. Subsequently, on the information supplied by petitioner No.1, Lav Kush Baitha, the dead body of

Patna High Court Cr.Misc. No.12153 of 2016 (2) dt.05-04-2016 2/2 daughter of informant in decomposed condition was recovered. It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled. Considering the nature of accusation, this court is not inclined to enlarge the petitioners on bail, at present. The prayer is rejected.

Let the trial be expedited.
