JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Buxar (M) P.S. Case No. 151 of 2019 for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the FIR and his name surfaced on the confessional statement of co-accused Diljale Thakur. Notwithstanding the fact that the petitioner was arrested in the month of July, 2019, he was not put on test identification parade. The petitioner is in custody since 07.07.2019. Considering the fact that the petitioner was not named in the FIR and he has not been put on test identification parade, the Court is inclined to grant bail to the petitioner.
