2. Learned counsel for the petitioner has submitted that the earlier regular bail petition of the petitioner was rejected by this Court vide order dated 18.04.2023 in Cr. Misc. No. 42257 of 2022. At the time of rejection of the bail application, it was observed that if the trial is not concluded within a period of six months, the petitioner may renew his prayer for bail.

3. Learned counsel for the petitioner has submitted that after a lapse of six months, the trial has not been concluded as yet and on this ground, two petitioners namely Satyanarayan Bhagat and Krishna Kumar have been granted bail vide order dated 05.01.2024 in Cr. Misc. No. 81231 of 2023 by this Court. The case of the petitioner is on exactly similar footing to that of co-accused

Patna High Court CR. MISC. No.8248 of 2024(2) dt.16-02-2024 2/2 persons.

Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge VIIIth, Muzaffarpur in connection With Paroo P.S. Case No. 95 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court.

(ii) If the petitioners are found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioners and the learned court below will take decision in accordance with law.
