The petitioner seeks bail in Runnisaidpur P.S. Case No. 96/2001, registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The petitioner is not named in the FIR. Charge-sheet was submitted against the petitioner showing him as absconder. It is submitted that Rajesh Choudhary and Dinesh Singh faced trial vide S.Tr. no. 76 of 2005/113 of 2008 and S.Tr. no. 350 of 2007/112 of 2008. Both the accused were acquitted. Petitioner was remanded in this case on 28.06.2014. The Additional Sessions Judge has reiterated that no process was issued against the petitioner before declaring him absconder, as the charge-sheet was submitted showing the petitioner absconder.

No.7821 of 2015 (3) dt.21-04-2015 2/2 Considering the aforesaid facts that the petitioner has already remained in jail for more than months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Adhoc ADJ-I in connection with Sitamarhi in connection with Runnisaidpur P.S. Case No. 96/2001.
