A counter affidavit has been filed on behalf of respondent no.2 depicting therein that confiscation proceeding being carried out by the Authorised Officer cum Divisional Forest Officer, Rohtas has concluded, final order has already been passed, whereupon, this petition has become infructuous as under Section 52(A) of the Indian Forest (Bihar Amendment) Act, final order is appealable one which, the petitioner may avail.
Accordingly, the instant petition lacks merit and is accordingly dismissed.
