Mr.Ram Sevak Choudhary ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-11-2022 Heard learned counsel for the petitioners and the State.

Petitioners apprehend their arrest in a case registered for the offence punishable under Section 363, 366/ 34 of the Indian Penal Code.

As per the prosecution case, these petitioners along with other accused persons kidnapped the daughter of informant.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in

Patna High Court CR. MISC. No.4646 of 2022(4) dt.14-11-2022 2/2 the case. The informant has clearly stated that due to old dispute accused persons kidnapped his daughter which creates doubt towards the veracity of the case.

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that victim in her statement u/s 164 of the Cr. P. C. has stated that when she had gone to Rahimpur, these petitioners along with other accused persons forcibly got her seated in a Bolero vehicle and demanded Rs. 10,00000/- from her father.

Considering the nature of accusation, gravity of the offence and statement of victim recorded u/s 164 of the Cr.P.C., I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
