JUSTICE PARTHA SARTHY ORAL ORDER 22-07-2021 Heard learned senior counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Complaint Case no. 23 C-2 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., on secret information having been received, a raid was conducted and 686.160 litres of IMFL was recovered from the maize field. The petitioner was identified as one of the accused persons who had managed to escape.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.14144 of 2021(2) dt.22-07-2021 2/2 that the allegations as levelled in the F.I.R. are false and concocted. Neither the field nor the seized liquor belongs to the petitioner. He is in custody since 9.11.2020 and has been falsely implicated in the case because of past dispute as a result of his antecedents.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the investigation in the case having concluded, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Complaint Case no. 23 C-2 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd-cum-Special Judge, Excise Act, Begusarai.
