2. The petitioner seeks bail registered in connection with Garhpura PS Case No. 80/2022 for the offence under Sections 365, 120B of the IPC

3. As per the prosecution case, the informant had received a call from one Mohammad Israfil having mobile no. 9142674245 that his younger brother, Md. Qyam Uddin is missing who had come from Haryana on 08.07.2022 on the occasion of Bakrid. When the informant had asked the petitioner regarding whereabouts of his brother, she gave a hazy reply.

4. Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next

Patna High Court CR. MISC. No.5260 of 2024(3) dt.27-03-2024 2/2 submits that the co-accused, Mohammad Israfil has been granted privilege of bail by the Co-ordinate Bench of this Court in Cr. Misc. No. 67597 of 2022 vide order dated 06.07.2023. Petitioner is in custody since 24.01.2024.

5. Learned APP appearing for the State, opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and the fact that the co-accused has been granted privilege of bail by the Co-ordinate Bench of this Court, let the petitioner, above named, be directed to be released on bail in connection with Garhpura PS Case No. 80/2022 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Ruby Kumari, learned Judicial Magistrate 1st Class, Begusarai.
