Mr. Umesh Kumar Mishra, learned counsel for the petitioner submits that the case of the petitioner is required to be considered in the light of the decision of the Apex Court in SLP (C ) No. 5328 of 2012 (Vishwanath Pandey Vs. The State of Bihar & Ors.).

Counsel appearing on behalf of the State submits that subsequent to this decision the Apex Court has recently decided the issue in the case of Mukesh Vs. State of Bihar & Ors: (2017)

Patna High Court CWJC No.4424 of 2017(2) dt.13-12-2017 2/2 5 SCC 387.

In view of the latest judgment of the Apex Court in the case of Mukesh (supra) the writ petition is disposed of with a direction to the respondents to take final decision in the light of the decision of the Apex Court in the case of Mukesh (supra) within a period of sixty days from the date of receipt/production of a copy of this order.
