Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Complaint Case No. 385 of 2019 registered for the offence punishable under Sections 420, 406, 417 and 506 of the Indian Penal Code.
The allegations levelled against the petitioner prima facie make out a civil dispute between the parties. Moreover, earlier to this petition, the petitioner had filed a complaint case
Patna High Court CR. MISC. No.14330 of 2021(4) dt.03-03-2022 2/2 under Section 376 of the Indian Penal Code. Despite service of notice, the complainant has chosen not to appear before this Court. There is no chance of the petitioner of absconding. Considering the facts and circumstances, the present anticipatory bail application is allowed.
Accordingly, let the petitioner, above named, be released on bail, in the even of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 2nd Class, Madhepura in connection with Complaint Case No. 385 of 2019, subject to the conditions as laid down under Section 43892) of the Cr.P.C.
