In view of the observation made in the impugned order dated 11.03.2022, Mr. Nilesh Sinha, learned counsel appearing on behalf of the petitioner claims parity with the similarly situated co-accused Kamlesh Kumar who has been released on bail after framing of the charge in connection with Special Case No. 5995 of 2021 arising out of Biharsharif P.S. Case No. 05 of 2021 and seeks permission of this Court to withdraw the present bail application with liberty to claim parity with the aforesaid similarly situated co-accused Kamlesh Kumar.
This case is permitted to be withdrawn taking into consideration the specific submission made by the petitioner who is claiming parity with the similarly situated co-accused
Patna High Court CR. MISC. No.4004 of 2022(2) dt.10-05-2022 2/2 Kamlesh Kumar who has been released on bail by the court below after framing of the charge.
Accordingly, the present bail application is dismissed as withdrawn.
