Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Siwan Town P.S. Case No. 597 of 2021 registered for the offences punishable under Sections 341, 323, 324, 307, 325, 379, 504, 506/34 of the Indian Penal Code.

As per allegation, the accused persons badly assaulted

No.4542 of 2022(2) dt.11-08-2022 2/3 the family members of the informant, The allegation against petitioner no.1 is that he assaulted the wife of the informant with iron rod. The specific allegation against petitioner no.3 is that he assaulted the informant on his head with an axe. The allegation against petitioner no.2 is that he assaulted son-in-law of the informant and petitioner no. 4 assaulted the daughter-in-law of the informant with hockey stick. The learned counsel for the petitioners has submitted that both the parties are agnates, there is a land dispute between the parties, there is case and counter-case, and the petitioners are the persons of clean antecedents. He has submitted further that the injured persons to whom there is allegation of assault against the petitioners, had sustained simple injuries.

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 597 of 2021, subject to condition as

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
