====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 07-06-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Matihani P.S. Case No. 113 of 2017 instituted for the offences under Sections 326, 302 and 34 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 21.11.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that informant alleges that co-accused persons namely Golu Kumar who is the son of the petitioner and Kanhaiya Kumar came and taking away the son of the informant from his house and went to the petitioner's house where the petitioner and co-accused persons attacked upon his son by sharp cutting weapon and fire

Patna High Court CR. MISC. No.3966 of 2022(2) dt.07-06-2022 2/2 arms in which son of the informant become badly injured. In course of treatment, son of the informant died. Learned counsel for the petitioner submits that the allegation was made against the petitioner only because he is the father of co-accused Golu Kumar. It is submitted that there is no material evidence against the petitioner in the case diary except confessional statement of Kanhaiya Kumar. There is no whisper about the allegation against the petitioner.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 21.11.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Begusarai in connection with Matihani P.S. Case No. 113 of 2017.
