Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends her arrest in connection with Sultanganj P.S. Case No. 122 of 2021 registered for the offences punishable under Sections 448, 341, 323, 324, 325, 307, 504, 506 and 34 of the Indian Penal Code. As per allegation, the accused persons, including the present petitioner assaulted the mothers of the informant. Learned counsel for the petitioner has submitted that the allegation against the petitioner is general and omnibus.
Patna High Court CR. MISC. No.4428 of 2022(2) dt.11-08-2022 2/2 He has submitted further that there is a land dispute between the parties and the petitioner is a lady of a clean antecedent. He has also submitted that co-accused Radha Devi and Indu Devi have been granted anticipatory bail, vide Criminal Miscellaneous No. 1175 of 2022.
Considering the above-mentioned facts and circumstances, as well as the clean antecedent of the petitioner, the petitioner above-named, in the event of her arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate Ist, Bhagalpur in connection with Sultanganj P.S. Case No. 122 of 2021, subject to condition as laid down under section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
