Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 379, 120B of the Indian Penal Code.

In the first information report, no specific overt-act has been attributed against the petitioner and it is only stated that petitioner used to take liquor in the company of F.I.R. named accused, Ajay Mandal and moreover, in course of investigation, some witnesses claimed that it was petitioner who hatched up the entire conspiracy of the present case.

Patna High Court Cr.Misc. No.10649 of 2016 (2) dt.08-03-2016 2/2 have any criminal antecedent. Moreover, it appears from perusal of the first information report that it was co-accused, Ajay Mandal, who gave fatal blow to the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 188 of 2015.
