2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 272, 273/34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

3. Earlier, petitioner was granted anticipatory bail on merit by another Bench of this Court vide order dated 19.12.2022 passed in Cr. Misc. 70382 of 2022 with a liberty to learned court below to accept his bail bond after verifying his criminal antecedents.

4. It is submitted by learned counsel for the petitioner that on verification by the court below, the petitioner was found

Patna High Court CR. MISC. No.4835 of 2024(2) dt.24-01-2024 2/2 having criminal antecedents in some other cases apart from the antecedents which were mentioned in his anticipatory bail petition. Thereafter, his bail bond was not accepted by the court below and the petitioner has been taken into custody on 4.1.2024 and since then he is languishing in judicial custody.

5. The application for bail is opposed by learned APP for the State and submitted that petitioner has got twelve criminal antecedents.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise-2, Samastipur in connection with Tajpur (Halai O.P.) P.S. Case No. 526 of 2022.
