2. Today, this case has been listed at Sr. No.6 under the heading 'For Admission-Fresh Cases'. Upon first call, no one appears on behalf of the petitioner, therefore, case has been fixed at 12.30 p.m. But again at 12.30 p.m., no one appears on behalf of the petitioner in-spite of the fact that there are two counsel on record.

3. Learned Counsel for the State has draw the attention of this Court on Annexure-1 which is order dated 18.03.2024 passed in Civil Writ Jurisdiction Case No.5105 of 2022 which states as follows:- "Heard the parties.

2. As prayed for, four weeks time is granted to the petitioner to remove

Patna High Court CWJC No.2587 of 2025(2) dt.24-02-2025 2/2 defects, as pointed out by the office, failing which the application shall stand rejected without further reference to the Bench.

3. In case, the order passed is not complied and the matter accordingly stands dismissed, subsequently, the same be posted under the heading 'To be Mentioned' alongwith 'Tied Up'

matters before the Bench on the 'TIED UP' day.

4. List this case after four weeks."

4. It transpires to this Court that petitioner has earlier moved before this Hon'ble Court in C.W.J.C. No.5105 of 2022 and case was dismissed on 18.03.2024 due to non-compliance of the order. Today also, no one appears on behalf of the petitioner to defend this case.

5. In this view of the matter, it transpires to this Court that the petitioner is not interested to pursue this case and therefore, this writ petition is hereby dismissed due to non prosecution.
