The petitioner seeks his bail in connection with Mokama P.S. Case No.193 of 2014 registered under Sections 395 of the IPC. The informant, the driver of Bolero Pick-up van bearing Registration No.BR-01-GD-0908, was carrying 33 pieces. Batteries and 120 pieces inverters and cleaner was also accompanying him. The petitioner and others intercepted the vehicle and looted the articles. The driver and the cleaner also disclose that their mobiles were also looted. During the course of investigation, the petitioner was apprehended and looted mobile bearing No.IMEI-911371756079050 was recovered from the possession of the petitioner. The petitioner was using the mobile with Sim No.822988149. The Sim was issued in the name of the informant.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) ahk/- U T
