The petitioner seeks bail in a case under Section 3 R. P. (U.P.) Act.

Neither the petitioner was arrested on the spot nor anything was recovered from his possession. Similarly situated co-accused, namely, Rajesh Paswan has already been enlarged on bail and the case of petitioner stands on same footing. The petitioner is in custody since 10.09.2014.

Considering the fact that although petitioner has got criminal antecedent but similarly situated co-accused has already been enlarged on bail and petitioner is in custody for last nine months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with
